BEING A BY-LAW RELATING TO THE APPOINTMENT OF AN ACTING MEDICAL OFFICER OF HEALTH OF
THE BOARD OF HEALTH FOR THE WELLINGTON-DUFFERIN-GUELPH HEALTH UNIT
(hereinafter referred to as the “Board”)
BY-LAW NO. 5
A By-law to Appoint an Acting Medical Officer of Health when the Medical Officer of Health and the Associate Medical Officer of Health for the Wellington-Dufferin-Guelph Health Unit are absent or unable to act.
WHEREAS the Medical Officer of Health for the Wellington-Dufferin-Guelph Health Unit may, from time to time, be absent or unable to act;
AND WHEREAS the Associate Medical Officer of Health for the Wellington-Dufferin-Guelph Health Unit may, from time to time, also be absent or unable to act;
AND WHEREAS section 69 of the Health Protection and Promotion Act, R.S.O. 1990, c.H.7, as amended requires the Board of Health to appoint a physician as an Acting Medical Officer of Health when the Medical Officer of Health and Associate Medical Officer of Health are absent or unable to act;
AND WHEREAS the said section 69 further provides that an Acting Medical Officer of Health shall perform the duties and has the authority to exercise the powers of a Medical Officer of Health;
AND WHEREAS Dr. Liana Nolan, the Medical Officer of Health for the Waterloo Health Unit, Dr. Hsiu-Li Wang, Associate Medical Officer of Health for the Waterloo Health Unit, Dr. Ian Arra, Medical Officer of Health for the Grey Bruce Health Unit, Dr. Miriam Klassen, Medical Officer of Health for the Perth District Health Unit, Dr. Elizabeth Richardson, Medical Officer of Health for the City of Hamilton Health Unit, Dr. Bart Harvey, Associate Medical Officer of Health for the City of Hamilton Health Unit, Dr. Julie Emili, Associate Medical Officer of Health for the City of Hamilton Health Unit, and Dr. Ninh Tran, Associate Medical Officer of Health for the City of Hamilton Health Unit have agreed to act as the Medical Officer of Health for the Wellington-Dufferin-Guelph Health Unit when the Medical Officer of Health and the Associate Medical Officer of Health for the Wellington-Dufferin-Guelph Health Unit are absent or unable to act;
NOW THEREFORE, THE BOARD OF HEALTH FOR THE WELLINGTON-DUFFERIN-GUELPH HEALTH UNIT HEREBY ENACTS AS FOLLOWS:
1. Dr. Liana Nolan is hereby appointed as the Acting Medical Officer of Health for the Wellington-Dufferin-Guelph Health Unit provided that the Medical Officer of Health and the Associate Medical Officer of Health for the Wellington-Dufferin-Guelph Health Unit are absent or unable to act pursuant to section 69 of the Health Protection and Promotion Act, R.S.O. 1990, c.H.7, as amended or any successor thereto.
2. Dr. Hsiu-Li Wang is hereby appointed as the Acting Medical Officer of Health for the Wellington-Dufferin-Guelph Health Unit provided that:
a) the Medical Officer of Health and the Associate Medical Officer of Health for the Wellington-Dufferin-Guelph Health Unit are absent or unable to act pursuant to section 69 of the Health Protection and Promotion Act, R.S.O. 1990, c.H.7, as amended or any successor thereto; and
b) Dr. Liana Nolan is absent or unable to perform the duties and exercise the powers of the Acting Medical Officer of Health.
3. Dr. Ian Arra is hereby appointed as the Acting Medical Officer of Health for the Wellington-Dufferin-Guelph Health Unit provided that:
a) The Medical Officer of Health and the Associate Medical Officer of Health for the Wellington-Dufferin-Guelph Health Unit are absent or unable to act pursuant to section 69 of the Health Protection and Promotion Act, R.S.O. 1990, c.H.7, as amended or any successor thereto; and
b) Dr. Liana Nolan and Dr. Hsiu-Li Wang are absent or unable to perform the duties and exercise the powers of an Acting Medical Officer of Health.
4. Dr. Miriam Klassen is hereby appointed as the Acting Medical Officer of Health for the Wellington-Dufferin-Guelph Health Unit provided that:
a) The Medical Officer of Health and the Associate Medical Officer of Health for the Wellington-Dufferin-Guelph Health Unit are absent or unable to act pursuant to section 69 of the Health Protection and Promotion Act, R.S.O. 1990, c.H.7, as amended or any successor thereto; and
b) Dr. Liana Nolan, Dr. Hsiu-Li Wang and Dr. Ian Arra are absent or unable to perform the duties and exercise the powers of an Acting Medical Officer of Health.
5. Dr. Elizabeth Richardson is hereby appointed as the Acting Medical Officer of Health for the Wellington-Dufferin-Guelph Health Unit provided that:
a) The Medical Officer of Health and the Associate Medical Officer of Health for the Wellington-Dufferin-Guelph Health Unit are absent or unable to act pursuant to section 69 of the Health Protection and Promotion Act, R.S.O. 1990, c.H.7, as amended or any successor thereto; and
b) Dr. Liana Nolan, Dr. Hsiu-Li Wang, Dr. Ian Arra and Dr. Miriam Klassen are absent or unable to perform the duties and exercise the powers of an Acting Medical Officer of Health.
6. Dr. Bart Harvey is hereby appointed as the Acting Medical Officer of Health for the Wellington-Dufferin-Guelph Health Unit provided that:
a) The Medical Officer of Health and the Associate Medical Officer of Health for the Wellington-Dufferin-Guelph Health Unit are absent or unable to act pursuant to section 69 of the Health Protection and Promotion Act, R.S.O. 1990, c.H.7, as amended or any successor thereto; and
b) Dr. Liana Nolan, Dr. Hsiu-Li Wang, Dr. Ian Arra, Dr. Miriam Klassen and Dr. Elizabeth Richardson are absent or unable to perform the duties and exercise the powers of an Acting Medical Officer of Health.
7. Dr. Julie Emili is hereby appointed as the Acting Medical Officer of Health for the Wellington-Dufferin-Guelph Health Unit provided that:
a) The Medical Officer of Health and the Associate Medical Officer of Health for the Wellington-Dufferin-Guelph Health Unit are absent or unable to act pursuant to section 69 of the Health Protection and Promotion Act, R.S.O. 1990, c.H.7, as amended or any successor thereto; and
b) Dr. Liana Nolan, Dr. Hsiu-Li Wang, Dr. Ian Arra, Dr. Miriam Klassen, Dr. Elizabeth Richardson and Dr. Bart Harvey are absent or unable to perform the duties and exercise the powers of an Acting Medical Officer of Health.
8. Dr. Ninh Tran is hereby appointed as the Acting Medical Officer of Health for the Wellington-Dufferin-Guelph Health Unit provided that:
a) the Medical Officer of Health and the Associate Medical Officer of Health for the Wellington-Dufferin-Guelph Health Unit are absent or unable to act pursuant to section 69 of the Health Protection and Promotion Act, R.S.O. 1990, c.H.7, as amended or any successor thereto; and
b) Dr. Liana Nolan, Dr. Hsiu-Li Wang, Dr. Ian Arra, Dr. Miriam Klassen, Dr. Elizabeth Richardson, Dr. Bart Harvey and Dr. Julie Emili are absent or unable to perform the duties and exercise the powers of an Acting Medical Officer of Health.
9. Any person appointed as an Acting Medical Officer of Health under this By-law shall, pursuant to section 69 of the Health Protection and Promotion Act, R.S.O. 1990, c.H.7, as amended or any successor thereto, perform the duties and shall have the authority to exercise the powers of the Medical Officer of Health for the Wellington-Dufferin-Guelph Health Unit.
10. This By-law shall come into force and effect on the date of its final passage.
