POLICY STATEMENT

Non-Canadians receiving care from a physician acting on behalf of Wellington-Dufferin-Guelph Public Health (WDGPH) will be asked to complete the form Governing Law and Jurisdiction Agreement for healthcare organizations as a means of protecting the physician against malpractice issues/complaints not covered under the Canadian Protective Medical Association (CMPA).

CMPA does not legally cover services rendered by physicians for clients who are not Canadian citizens. As a result, the CMPA has created a form for physicians to complete with the client as a means of legal protection. The form can be found on the following website:

SCOPE:

This policy applies to physicians providing service on behalf of WDGPH to non-Canadian citizens.

DEFINITIONS:

Non-Canadians – Anyone without Canadian citizenship, including international students. They may reside in Canada temporarily and then return to his or her country of origin.

PROCEDURE

If it is determined that a client is a non-Canadian and is receiving physician services on behalf of Wellington-Dufferin-Guelph Public Health (WDGPH), the physician will give the the client a Governing Law and Jurisdiction Agreement for healthcare organizations to complete. The physician will explain the nature of the form to the client and ensure an understanding of its purpose.

Completed forms will be scanned and uploaded into the client electronic medical record by reception staff following the appointment. 

RESPONSIBILITY

Management will:

  • Ensure access to the form Governing Law and Jurisdiction Agreement for healthcare organizations; and
  • Ensure employees understand and are aware of the policy.

Employees will:

  • Physicians working on behalf of WDGPH, will provide a Governing Law and Jurisdiction Agreement for healthcare organizations to non-Canadians receiving physician services on behalf of WDGPH. Explain the purpose of the form and assist the client to complete it as needed; and
  • Reception will scan the form into the client chart.
