POLICY STATEMENT

Wellington-Dufferin-Guelph Public Health (WDGPH) recognizes the need to provide service to the public outside normal office hours. Management employees are expected to flex their schedule to fulfill their duties and achieve performance standards.

WDGPH will compensate management as outlined in this policy to recognize the hours worked beyond 35 hours throughout each year. No carryover of any compensating time from one year to the next year will be permitted.  

SCOPE

This policy applies to all WDGPH management (employees at Salary Band 8 or above).

BACKGROUND:  

WDGPH recognizes that management may be required to work beyond the normal 35 hours per week due to Agency needs. The normal hours of work shall be 35 hours per week, consisting of seven hours per day, excluding meal periods.

The Ontario Employment Standards Act, 2000 states that Managers do not qualify for overtime if the work they do is managerial or supervisory. Even if they perform other kinds of tasks that are not managerial or supervisory, they do not receive overtime pay if these tasks are performed on an irregular or exceptional basis.

Flex Time

Management employees have the authority to flex their hours worked according to program needs. Flex time is defined as scheduling seven consecutive hours of work excluding meal periods, between 7:30 a.m. and 11:00 p.m. or flexible hours of work per day over a 70-hour pay period. There is no need to log flex time.

Service delivery must be maintained and scheduling of flex time must be done to ensure service delivery across the program, division and Agency.

Management Compensating Time

Management employees with 1.0 FTE status will receive 35 hours of compensating time on January 1st of each calendar year (management with less than 1.0 FTE status will have these hours prorated to align with their status 0.8, 0.6, etc.).  This compensating time must be used within the calendar year awarded. Management staff must log the time as Management Comp when they actually take the time off. There is no need to log time worked. No additional compensating time will be awarded under this category.

Management Compensating Time (On-Call)

Management employees with 1.0 FTE status, who are on the “On-Call Schedule” will receive an additional 35 hours of compensating time on January 1st of each calendar year (management with less than 1.0 FTE status will have these hours prorated to align with their status 0.8, 0.6, etc.).  This compensating time must be used within the calendar year awarded.  Management employees must log the time as Management Comp On-Call when they actually take the time off. There is no need to log time worked. No additional compensating time will be awarded under this category.

Prorating of management compensation time may apply to management who are hired within the year, take an extended leave of absence, resign or are terminated during the current year.
